Sibiya on the stand pleaded not guilty to the charges against him. He testified that during his arrested he was staying with the said baby who is the reason he is in custody at the present moment. The state prosecutor argued that the victim is afraid of the accused and further stated that the accused is able of tracing her from wherever she is and tries to amend things.
Defence argued as to how the victim was afraid of the accused if they were able to birth another child who is now one year three months after the alleged shooting.
Magistrate Cornu Roos of the Evander magistrate court denied bail on basis that the accused is not employed and does not seem to know the profits he makes in his alleged shisanyama business. Magistrate Roos furthermore stated that the accused might evade trial if released and he does not have any property and from his testimonial he is someone who does not stay in one place therefore he might be a flight risk.
He was therefore remanded in custody until his trial resumes
