Sifiso Michael Nkosi appeared before the Evander magistrate’s court for his formal bail application on Tuesday 28 January 2024.
Nkosi is facing one count of murder and one count of attempted murder of his girlfriend who is a constable stationed at eMbalenhle police station.
Nkosi was arrested on the 14th of November 2024 in the North West province, after his constable girlfriend and a male victim were shot at the previous night, the male victim succumbed to his wounds in the hospital.
Through an affidavit submitted by the defense and read in court, Nkosi stated that during the day of the incident, the deceased tried taking something out of his pocket when he fired warning shots; thereafter, a squabble broke out, which led to the deceased being shot.
Warrant Officer Mthombeni, testified at the witness stand. During his testimony, he said the accused, on the day of the incident, received information that his girlfriend, the police constable, and the deceased were at a certain location, and upon the accused’s arrival, seeing the two, the accused shot at the deceased in the head and the constable was shot in the body, and fled the scene.
The investigation officer further testified that upon the accused’s arrest, a firearm suspected to have been used in the commission of the crime was recovered in the car when the police cornered him. The licensed firearm belonged to the accused, and its license had already expired during the commission of the crime.
Upon further investigation, the investigation officer testified that the same firearm recovered in the possession of the accused was registered as stolen by his girlfriend who is a constable, and an affidavit made by the accused stating that the firearm was stolen during a house robbery in June 2024 was also submitted.
The investigation officer opposed the bail because the accused allegedly told him during his arrest that should he get a chance he would commit suicide, He further mentioned that the accused has a history of violence wherein in another incident he shot at his wife in the house three times but missed and furthermore the wife had a protection order against the accused.
