A 39- year-old taxi driver from eMbalenhle appeared in Evander Magistrate Court on Wednesday, 08 February 2023 for allegedly raping and pointing his ex-girlfriend with firearm at eMbalenhle Ext 22.
It is alleged that the accused was trying to revive his love life with his ex-girlfriend after they broke up last year November 2022, as we was still in contract with the mother of his child.
It is reported that the accused met his ex-girlfriend on the street in eMbalenhle while he was coming from work during the first week of February 2023, that’s when they had agreement to go together to his place with his private vehicle.
Upon arrival at home it is alleged that the victim agreed to sleepover and contacted her elder sister that she won’t be coming home during that day as she is trying to fix her relationship with the accused boyfriend.
The victim alleges that during the sleep-over, she was pointed at with a gun and raped by the accused at his house where he resides.
The ex-girlfriend further alleged the accused and forced her to do his laundry at the same day just after raping her.
Meanwhile the accused on the stand in Evander Magistrate Court stated that all the allegation against him are false, he was also surprised to find out that his ex-girlfriend opened a case against him because at the beginning they had an agreement to have sexual intercourse.
He further stated that things got sour when his other baby mama texted him whilst he was with the alleged victim, which he believes could be the trigger which made the ex-girlfriend angry to the point she opened a case of rape.
The Investigation officer stated that further investigation have been conducted which shows that they indeed had sexual intercourse, however further investigation will be conducted to find out if its forced intercourse or not and the police could not locate the alleged firearm at the moment at the accused premises.
Evander Magistrate Court granted the accused bail of R1000 with bail condition that he must not get contact with the victim until further investigation.
However it is also reported that the victim is willing to drop the charges against the accused.
