Nonhlanhla Nkosi and her co-accused, Mandla Skhosana, Sibusiso Skhosana, and Seun Mpendzi, reappeared before the Evander Magistrate Court on Wednesday, 06 November 2024, for their formal bail application on the charges of premeditated murder, kidnapping, and robbery with aggravating circumstances.

The four are accused of the premeditated murder of Sifiso Lucky Kubheka from eMbalenhle.

The four have been in custody for the past six months after abandoning their first bail application.

Detective Mthombeni of the SAPS testified that the four are a flight risk and should not be released on bail.

He further testified that during the time of their arrest Nonhlanhla and Mandla were on the N17 towards Bethal, where it was alleged, they were en-route to Swaziland trying to evade arrest. The duo is said to have been in possession of passports during the time of their arrest.

The defense argued that the duo (accused one and two) cooperated with the investigation officer during the time of their arrest.

The court was certified that the evidence against accused one and two was that they were indeed a flight risk, as they were willing to leave all family ties and flee to Swaziland. As far as accused no. three and four, the court was certified that they did not prove beyond reasonable doubt that there are exceptional circumstances that they be released.

All four accused were denied bail and remanded in custody till their trial commences.
