A 36 year old male appeared before the Evander Magistrate Court on Monday, 04 September 2023 for his sentencing after he was found guilty on three counts of Rape.
Mduduzi Pat Nkosi was sentenced to life imprisonment on on the first count of rape, five (5) years on the second of sexual grooming another five (5) years for making a minor watch pornography.
Nkosi raped his ten (10) year old niece on four occasions where he used to make his niece watch adult videos before raping her, thereby bribing her with money for sweets.
After five (5) years the incident had taken place the victim reported the matter to her mother who acted swiftly and reported the matter to the police.
During trial the victim testified she had initially reported the matter to her grandmother who promised her she will reprimand the uncle.
But instead the rape continued which the made the victim feet let down by the one person she trusted the most when her grandmother did not take her seriously. The victim was therefore afraid to report the matter to her mother at the time as she was always at work during the time of the incident.
After the matter was reported to the police station Nkosi fled to Nelspruit resisting arrest.
Nkosi was later apprehended in April 2021 and taken into custody with no bail as he was considered a flight risk.
Medical reports proved the victim that she had been raped.
During cross examination Nkosi denied that he lived at the residence where the incident happened during that time but later contradicted himself saying the victim would come watch TV in his room.
The magistrate noted on her notes during The victims testimony that she is a good child as she was consistent in answering her questions.
Meanwhile Nkosi’s versions had nothing tangible, as he denied staying at the backroom but later on says he stayed there as he had girlfriends, furthermore his versions kept changing.
Nkosi was therefore found guilty on all three charges.
