The Democratic Alliance filled an urgent application at the Middleburg High Court against Govan Mbeki Municipality and its Council for the removal of the speaker, Cllr Fikile Magamela.
The said application was was sough to be heard today, 14 June 2022 and was placed on the urgent motion role.
The case was struck from the roll with costs by Judge Thando Mankage.
Mankage stated that there is no urgency in this matter and should therefore not have been placed on the urgent role.
Cllr Nhlakanipho Zuma, the Executive Mayor of GMM, in a statement he made this afternoon, welcomes the the decision of the High Court.
“Today we have received information that the matter which was presented by the Democratic Alliance was struck from the record with costs and therefore council is back to its operation as normal,” said the Executive Mayor joined by the speaker as he makes a media statement.
“Like we said the speaker still remains the speaker of council up until due processes which certain parties feel they want to process but at the current moment, there is no motion of no confidence and council is continuing with its responsibilities as it should,” added Cllr Zuma.
