Lindokuhle Sibiya appeared before the Evander magistrate’s court on Tuesday, 04 April 2023 for the attempted murder of his girlfriend and mother of his two children.
Sibiya was arrested in Vrede last year in September for the attempted murder of his baby momma.
It is alleged the accused shot at his girlfriend whilst in eMbalenhle where he was visiting her in the year 2020.
Sibiya, on the stand, pleaded not guilty to the charges against him.
He testified that during his arrest, he was staying with the said baby mama who is the reason he is in custody at the present moment.
Sibiya alleged that since the year 2020, he has been living with the victim at their residence in Everton settlement and that they now even have a second born child who is one year-three months old.
He further alleged that during his arrest in Vrede, he had taken his baby momma there for cleansing because she had bad luck in securing employment.
He was therefore shot at by people unknown to him who posed as police officers and were not in uniform, who then took him into custody.
The state prosecutor argued that the victim is afraid of the accused and further stated that the accused is able to track her from wherever she is and tries to amend things.
The defence argued as to how the victim was afraid of the accused if they were able to birth another child who is now one year and three months after the alleged shooting.
Magistrate Cornu Roos of the Evander Magistrate court denied bail on the basis that the accused is not employed and does not seem to know the profits he makes in his alleged shisanyama business. Magistrate Roos furthermore stated that the accused might evade trial if released and he does not have any property and, from his testimonial, he is someone who does not stay in one place, therefore he might be a flight risk.
He was therefore remanded in custody until his trial resumes.
